Delivery and Return Conditions

CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND REFUND CONDITIONS

GENERAL:

  1. By placing an order electronically through the website you are using, you are deemed to have accepted the pre-information form and the distance selling contract presented to you.

  2. Buyers are subject to the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts (RG: 27.11.2014/29188), and other applicable laws, regarding the sale and delivery of the product they purchased.

  3. Shipping costs, which are the expenses incurred for product delivery, will be paid by the buyers.

  4. Each purchased product will be delivered to the person and/or organization at the address indicated by the buyer, provided that the delivery does not exceed the 30-day legal period. If the product is not delivered within this period, the buyer may terminate the contract.

  5. The purchased product must be delivered complete and in accordance with the specifications stated in the order, along with any warranty certificate, user manual, and other relevant documents.

  6. If the purchased product becomes impossible to sell, the seller must notify the buyer in writing within 3 days of learning of this situation. The total amount must be refunded to the buyer within 14 days.

IF THE PURCHASED PRODUCT IS NOT PAID FOR:

  1. If the buyer does not pay for the product they purchased or cancels the payment in bank records, the Seller's obligation to deliver the product ends.

PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:

  1. If, after delivery of the product, it is determined that the buyer's credit card used for payment has been fraudulently used by unauthorized persons, and the price of the sold product is not paid to the Seller by the relevant bank or financial institution, the Buyer is obligated to return the product to the Seller within 3 days, with the shipping costs borne by the SELLER.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:

  1. If unforeseen circumstances beyond the Seller's control prevent timely delivery of the product, the Buyer will be notified. The Buyer may request cancellation of the order, replacement with a similar product, or postponement of delivery until the impediment is removed. If the Buyer cancels the order and has paid in cash, the payment will be refunded within 14 days of cancellation. If the Buyer paid by credit card and cancels, the product price will be refunded to the bank within 14 days of cancellation; however, it may take the bank 2-3 weeks to credit the Buyer's account.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

  1. The buyer will inspect the goods/services subject to the contract before taking delivery; they will not accept damaged or defective goods/services (e.g., dented, broken, packaging torn) from the shipping company. The goods/services received will be considered undamaged and intact. The BUYER is obligated to carefully protect the goods/services after delivery. If the right of withdrawal is to be exercised, the goods/services must not be used. The invoice must also be returned with the product.

RIGHT OF WITHDRAWAL:

  1. The BUYER may exercise the right to withdraw from the contract by rejecting the goods within 14 (fourteen) days from the date of delivery of the purchased product to him/her or the person/organization at the address indicated, without assuming any legal or penal liability and without giving any reason, provided that he/she notifies the SELLER through the following contact information.

DURATION OF THE RIGHT OF WITHDRAWAL:

  1. If the purchase is a service, this 14-day period begins from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where performance of the service has begun with the consumer's consent before the withdrawal period expires.

  2. The costs arising from the exercise of the right of withdrawal shall be borne by the SELLER.

  3. To exercise the right of withdrawal, a written notification must be sent to the SELLER within 14 (fourteen) days via registered mail, fax, or email, and the product must not have been used in accordance with the "Products for Which the Right of Withdrawal Cannot Be Used" provisions stipulated in this agreement.

EXERCISING THE RIGHT OF WITHDRAWAL:

  1. The invoice for the product delivered to the 3rd party or the RECIPIENT (If the invoice for the product to be returned is a corporate invoice, it must be sent with the return invoice issued by the company when returning it. Order returns with invoices issued in the name of companies cannot be completed unless a RETURN INVOICE is issued.)

  2. The return form, the box and packaging of the products to be returned, and any standard accessories must be delivered complete and undamaged.

RETURN POLICY:

  1. The SELLER is obligated to return the total amount and the documents that bind the BUYER to debt to the BUYER within a maximum of 10 days from the date of receipt of the withdrawal notice, and to take back the goods within 20 days.

  2. If the value of the goods decreases or return becomes impossible due to a reason caused by the BUYER's fault, the BUYER is obliged to compensate the SELLER for the damages in proportion to the fault. However, the BUYER is not responsible for changes and deteriorations caused by the proper use of the goods or product within the withdrawal period.

  3. If the order total falls below the minimum purchase amount for the promotion due to the exercise of the right of withdrawal, the discount applied within the scope of the promotion will be cancelled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

  1. Goods prepared at the BUYER's request or specifically for their personal needs and unsuitable for return, including underwear bottoms, swimwear bottoms, makeup, disposable items, perishable goods or goods with an expiry date, goods whose packaging has been opened by the BUYER after delivery and whose return is unsuitable for health and hygiene reasons, goods that have been mixed with other goods after delivery and cannot be separated by their nature, goods relating to periodicals such as newspapers and magazines (excluding those provided under a subscription agreement), services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer, and sound or image recordings, books, digital content, software programs, data recording and storage devices, computer consumables, cannot be returned if their packaging has been opened by the BUYER, as per the Regulation. Furthermore, exercising the right of withdrawal for services whose performance has begun with the consumer's approval before the expiry of the withdrawal period is also not possible as per the Regulation.

  2. Cosmetics and personal care products, underwear, swimwear, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery supplies (toner, cartridges, ribbons, etc.) must be unopened, untried, undamaged and unused in order to be returned.

DEFAULT AND ITS LEGAL CONSEQUENCES

  1. If the BUYER defaults on payments made via credit card, they acknowledge, declare, and undertake to pay interest and be liable to the card-issuing bank in accordance with the credit card agreement between them. In this case, the relevant bank may resort to legal action; it may claim the resulting expenses and attorney's fees from the BUYER, and in any case, if the BUYER defaults on their debt, the BUYER agrees to pay the SELLER for any damages and losses incurred due to the delayed performance of the debt.

  1. You can make a bank transfer or EFT (Electronic Funds Transfer) to any of our Kuwait Türk bank accounts (in TL).

  2. You can use your credit cards to make online single payments or online installment payments for all types of credit cards through our website. Your credit card will be charged at the end of your order during the online payment process.
